Terms of Service

These Terms of Service ("Terms") govern your use of the TradeOff mobile application (the "App") operated by TradeOff ("we", "us", "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the App. By registering, you confirm that you meet these requirements.

2. Your Account

• You are responsible for maintaining the security of your account credentials, including your password and any two-factor authentication methods.
• You must provide accurate, current information when creating your account and keep it up to date.
• You may not create multiple accounts, impersonate another person, or transfer your account to anyone else.
• You are responsible for all activity that occurs under your account.

3. How the App Works

TradeOff is a platform that connects users who wish to exchange skills and services with one another. We facilitate introductions and provide tools for communication, proposals, and trade tracking.

• We are not a party to any trade. All arrangements, including scope, timing, and quality of work, are between the users involved.
• We do not guarantee the quality, safety, legality, or completion of any service offered or exchanged through the App.
• You are solely responsible for evaluating other users and deciding whether to enter into a trade.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose or to offer illegal services
• Harass, threaten, abuse, or discriminate against other users
• Post false, misleading, or deceptive information in your profile or service listings
• Spam other users or send unsolicited commercial messages
• Attempt to access another user's account or data
• Interfere with the operation of the App or circumvent security measures
• Use the App to collect personal data about other users for purposes unrelated to trading
• Offer services that require professional licensing unless you hold the relevant licence

5. Content You Post

• You retain ownership of content you submit (profile information, service listings, photos, messages, reviews).
• By posting content, you grant us a non-exclusive, royalty-free licence to display, store, and distribute it within the App as necessary to operate the service.
• You must not post content that is defamatory, obscene, infringing on intellectual property rights, or otherwise objectionable.
• We may remove content that violates these Terms without notice.

6. Ratings and Reviews

• Reviews must be honest and based on genuine trade experiences.
• You may not offer incentives for positive reviews or post retaliatory reviews.
• We do not arbitrate review disputes, but we may remove reviews that violate these Terms.

7. Disputes Between Users

We offer an in-app arbitration process to help resolve disagreements between trade partners. This is a voluntary, informal process — not legal arbitration.

• Either party in a trade may request arbitration through the App.
• We will review the case and may suggest a resolution, but we cannot enforce it.
• We are not liable for the outcome of any trade or dispute.

8. Suspension and Termination

• We may suspend or terminate your account at any time if you violate these Terms, engage in abusive behaviour, or pose a risk to other users.
• You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

9. Limitation of Liability

To the fullest extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any loss, damage, or injury arising from your use of the App or any trade conducted through it.
• We are not responsible for the actions, conduct, or content of any user.
• Our total liability to you for any claim arising from these Terms shall not exceed the amount you have paid us (which, as a free service, is zero).

10. Indemnification

You agree to indemnify and hold harmless TradeOff, its officers, and employees from any claims, losses, or damages arising from your use of the App, your content, or your violation of these Terms.

11. Intellectual Property

The App, including its design, branding, code, and documentation, is owned by TradeOff and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
